There are four classes of Theft in Hawaii:

1.  Theft 1 - This is when someone steals a gun, Dynamite or and explosive, property or services over $300 during a governor declared emergency, property or services worth $750 or more from a person known to be over 60 years old, a person steals a car or motorcycle, or steals something worth over $20,000.  This is a Class B felony with a possible 10 years in jail and/or $25,000.00 fine;

2.  Theft 2 - This is applicable to pick pocketing an item of any value, property or services over $750, or Aquacultural products from a fenced property with no trespass signs.  This is a Class C felony with a possible 5 years in jail and/or $10,000 fine;

3.  Theft 3 - This is when someone steals something worth over $250, or steals gas or other petroleum products.  It is a full misdemeanor with a maximum possible 1 year in jail and/or a $2000 fine.

4.  Theft 4 - This is when someone steals something worth $250 or less.  It is a Petty Misdemeanor with a maximum possible penalty of 30 days in jail and/or $1000.00 fine.

Shoplifting is leaving a store without paying for goods.  It is basically a theft with the case classified by the values above.

Mr. Burge has represented hundreds of persons accused of Shoplifting and/or Theft.  If this is your first offense, you may be able to keep your record clean even if you were guilty if charged with Theft 1 through 4.
