If convicted there are mandatory sentences without probation or deferral (wiping case off your record) as follows:


FIRST OFFENSE:  NO PREVIOUS CONVICTION WITHIN THE LAST 10 YEARS

1.  Mandatory 14 hour substance abuse class and alcohol assessment and recommended treatment;

2.  $413 in court fees and between $250 and $1,000 fine;

3.  Between 2 and 5 days in jail and 72 hours jail can also be imposed by the judge;

4.  One year license revocation but you can driving with a breath machine in car for the year if you were licensed at the time of your arrest.

5.  If you blow .15 .bac or higher there is a mandatory 48 hours in jail;


2ND OFFENSE WITHIN TEN YEARS OF A PRIOR CONVICTION:


1.  Alcohol assessment and treatment if warranted;

2.  Between $1000 and $3000 fine and $436 in court fees;

3.  Either or both of 5-30 days in jail or 240 hours of community service work;

4.  2-3 year license revocation but you can drive witb an interlock installed if you were licensed when arrested;

5.  If your .bac was .15 or higher there is a mandatory 10 days, up to 30 days in jail.


2 OR MORE CONVICTIONS WITHIN TEN YEARS:


1.  Either

     a.  5 years in jail; or

     b.  5 years probation with a mandatory 10 days, with up to 18 months in jail along with between 2-5,000      dollar fine and 3-5 year license revocation;

2.   The car you were driving can be forfeited;

3.  If above .15 .bac there is a mandatory 10 year prison sentence.
