Forfeitures

 

Hawaii has laws allowing for forfeiture of the property of persons suspected of most types of crime.  The police can and do use these laws to take away property every day.  Once the property is taken, you have to prove that it was not used to facilitate the crime.  A lot of people lose their cars for a relatively small amount of drugs.  To fight the forfeiture, you have to put up a cost bond worth $2,500.00 or 10% of the seized property, whichever is greater, unless you can show the court that you cannot afford to do so.  Mr. Burge has handled a number of forfeitures and is available to discuss this further by appointment.
